🚨 BREAKING: The City of San Diego just appealed 🚨 BREAKING: The City of San Diego just appealed our 9th Circuit victory—the one that said teaching donation-based yoga in public parks is protected by the First Amendment.⁣ ⁣ The City is arguing that accepting any donation = running a business, and that that makes my yoga classes at Sunset Cliffs (and all donation yoga) “commercial activity” which can be banned. But here’s the truth: courts have already ruled that teaching yoga—even with a donation jar—is still protected free speech. So while we’re pretty confident the City’s appeal will be denied, it’s still important to note that their attack continues. And who is it serving, really? Definitely not the majority public who come to these gatherings for free to improve their mental and physical health and gain community. 🧘🏻‍♀️⁣ ⁣ This fight is bigger than yoga. It’s about who gets to gather in public, and what we’re allowed to share. Movement. Breath. Healing. These aren’t products—they’re human rights. The City of San Diego has lied countless times to the courts, claiming we could just get permits, while simultaneously refusing to offer permits for yoga at ANY shoreline park (and now claiming that permits are “just blocked for the summer” in an odd twist in their appeal, considering the evidence).⁣ ⁣ The City may have money and their “creative” lawyer. But we’ve got truth, community, and the Constitution on our side. And I’ll keep shouting it from the (cliff)tops: Community care is not a crime!⁣ ⁣ We’re not giving up—the future looks bright. Me and @namasteveyoga are holding strong in the lawsuit with our lawyer @animalawyer, and we’re going to make sure that yoga at the beach is here to stay.⁣ ⁣ 👇 What do you like most about yoga at Sunset Cliffs or any of the other shoreline parks of San Diego? BIG NEWS: Yogis won. 🙌🏼 As if there was ever BIG NEWS: Yogis won. 🙌🏼 As if there was ever any doubt. 😏 The Ninth Circuit Court of Appeals just ruled in favor of me and @namasteveyoga—teaching yoga is protected by the First Amendment. Which means the City of San Diego’s ban on donation-based yoga classes is officially unconstitutional.⁣ ⁣ If you’ve been following my journey, you know the City shut down my community yoga classes at Sunset Cliffs last year and threatened me with criminal charges if I continued. But the 9th circuit court disagreed with the city’s ordinance—because sharing movement, breath, and philosophy without charging anything is expression. 🧘🏻‍♀️ And public parks are for the people.⁣ ⁣ So what does this mean? I can legally return to teaching at Sunset Cliffs (and believe me, while I can’t teach every week I’m definitely organizing Mind Body Badass classes with my team of awesome instructors). This ruling sets a powerful precedent for every yoga teacher who wants to hold space for community in public parks.⁣ ⁣ This isn’t just a yoga win.⁣ It’s a free speech win. A wellness access win. A we belong here win. 🙌🏼⁣ ⁣ We’re not *officially* done yet with our litigation, but the court ruling made it clear that Steve and I will win. ✊🏼 Take a big breath with me and really take in this good news!!!
